Contract Agreement Terms

  • ALL PAYMENTS are due in FULL, to be paid to Mosaic Mind, Body and Spirit Magazine Ltd., (Mosaic), based on the particular article and/or advertising spaces you have chosen through  Mosaic’s website shopping cart.  Partial or staggered payments are no longer accepted and cancellation is not an option (once the space has been purchased), so please make your choices with that knowledge in mind.  Instead other options (changing your types/sizes/frequency of ads or changing from articles to ads, or vice versa) are possibilities, depending on availability and agreement from the Editor.
  • YOUR PAYMENT itself (and Mosaic’s acceptance of that payment) will serve as your full agreement to our terms/conditions and will thereby serve as a binding contract between Mosaic Mind, Body and Spirit Magazine Ltd. (Mosaic), and the client (company and/or individual) who has purchased article or advertising space. You are therefore hereby agreeing that your payment to Mosaic is in lieu of (and has the same weight as though) you literally signed the contract between us. 
  • GRAPHIC DESIGN is not included in the price of the ad space. If you need help, a professional graphic designer (that Mosaic also uses on a contract basis) is available to you at a very reasonable price.  Please email mosaicmagazine@shaw.ca for more information.
  • ADS and PROFILES can change once per month when you purchase an advertising package of 3, 6 or 12 months (please note there will be a $25 charge for each additional change during that month). Placement of all display ads is random and items in Marketplace and Profiles will be placed alphabetically. Event ads will be in date order and then alphabetically.  Mosaic does not accept any responsibility for any errors, omissions, content or color/resolution discrepancies in your ad or profile.  We reserve the right to refuse any ad or profile.
  • ARTICLE WRITERS must provide their articles in the specified time-frame agreed to with Mosaic at the beginning of your purchase/contract. Failure to meet your article deadline can result in the loss of your article (and payment) for that month and that will be at the discretion of the Editor.  Mosaic does not accept any responsibility for any errors, omissions or content in the articles/profiles/ads.  The Editor reserves the right to edit/revise articles for clarity, content and length, and has final approval.  Mosaic reserves the right to refuse any article.  Mosaic reserves the right to incorporate a piece of artwork chose by the Editor to appear in each article.  Mosaic must be informed if we are republishing a previously published article, as we must acknowledge that at the end of the article.
  • RELEASE AGREEMENT – Following your payment and submission of an article, profile, ad or artwork for publication in Mosaic Mind, Body and Spirit Magazine Ltd., the client/advertiser/writer/artist acknowledges and agrees to the following:
  • You have read/seen the final edited/revised version of the article, profile or ad and agree to its publication as it is.
  • You are the true author/owner of this article, profile, ad or artwork and you declare that none of this article, profile, ad or artwork has been plagiarized.
  • Due to copyright laws, you state that you have NOT provided Mosaic Magazine with the exact same article that you have already published in another magazine/publication, without first advising Mosaic’s Editor of same as we must acknowledge this at the end of your article.
  • You have given the appropriate credit necessary to all sources, books, etc., mentioned in your article, profile, ad or artwork.
  • You solely take responsible for the absolute entirety of your article, profile, ad or artwork, especially in the event of any inaccuracies, and acknowledge that Mosaic Mind, Body and Spirit Magazine Ltd., (or its contractors or affiliates) is not accountable in any way for this information or any errors, even unintentional ones.
  • In the event that you have mentioned someone you personally know in your article, profile, ad or artwork, directly naming them and making statements about them that are not public information but known only to you, you declare that you have obtained both verbal and also written permission from that person(s) and provide a copy of same to Mosaic. In the event that you have referred to someone you have personal knowledge about in your article, profile, ad or artwork, but whose name you have changed to obscure their identity, you declare that you have obtained verbal and/or written permission from them (the onus is on you to determine which).  In all events, this said person(s) agrees that all the information you have written in regards to him/her is accurate and he/she will not hold Magazine Ltd., (or contractors or affiliates) accountable for any information in the article that is not accurate.
  • You have the permission of all the people you have directly quoted in your article, profile, ad or artwork, and state that they had clear knowledge that you would be using their names and quotes in an article, profile, ad or artwork. You declare that you have obtained verbal and/or written permission from them (the onus is on me to determine which). In all events, this said person(s) agrees that all the information you have written in regards to him/her is accurate and he/she will not hold Mosaic Mind, Body and Spirit Magazine Ltd. (or contractors or affiliates) accountable for any information in the article that is not accurate.
  • You understand that although your published article is copyrighted to Mosaic Mind, Body and Spirit Magazine, it is your property and you can publish it again. However, if you have it published with the wording exactly as it was published in Mosaic, you will kindly acknowledge (at the bottom of the article) that it was first published in Mosaic Mind, Body and Spirit Magazine Ltd., and the date it was published.  Example:  First published on Mosaic Mind, Body and Spirit Magazine’s website on August 1, 2020. 
  • You agree to all the terms set out in this Mosaic Mind, Body and Spirit Magazine Contract Agreement.
